The Kingdom of Nye Terms of Use

This website is established and dedicated to entertainment and education. The following policies apply to all users of the website. Use of the website implies an understand and acceptance of the following terms and conditions.

(A) Notification of Changes to Terms of Use: The following Terms of Use, including additional terms and conditions presented here, are subject to modification, addition or removal without prior notification. Changes are effective immediately and continued use indicates acceptance of the changes.

(B) Services: The Kingdom of Nye can discontinue or alter any aspect of the site that is not specifically included with subscription without any prior notice. Items governed under subscriptions are Looking Glass and Archives, including all pre-recorded and previously aired shows, and are subject to notice prior to alteration or discontinuation.

(C) Membership and Subscriptions: The Kingdom of Nye offers access to a Members Only section for a monthly fee.
(1) User Responsibility: The user is responsible for their personal passwords and access to the site and acknowledge their personal responsibility for any item, information or communication posted while logged into the Members Only area.
(2) Cancellations: A Member may cancel their subscription at any time without question or penalization. A cancelled Membership will expire 30 days from the last date of membership paid fee.
(3) Refunds: Refunds will only be processed if a request is made within 24 hours of the last date of membership fee paid. Requests for such can be sent to subscribers@thekingdomofnye.com
(4) Terminations: The Kingdom of Nye retains the right to terminate a subscription for the following reasons without issuing a Refund:
(i) Continued harassment or verbal abuse of Host or Staff.
(ii) Digital Piracy, the distribution of materials located only within the Members Only area, including but not limited to, Archived Shows and Exclusive Interviews

(iii) Payments: No refund will be issued for the month in which the banning has occured or for months previous to the banning. A refund will be issued within 30 days for the remaining amount of a 3 month, 6 month or 12 month purchase. The cancellation of recurring payments is the responsibility of the member. No refunds will be issued for continuation of your subscription after a banning has occured.

(D) Material Submissions: The user agrees not to forward or upload any of the following
(1) Previously copyrighted materials or materials that infringe on the rights of others
(2) Any artwork which they do not personally own the rights
(3) Any materials which are sexually explicit, depict the abuse of humans/animals, or which may be considered offensive to the general public.
(4) Any material they know to be false or intentionally misleading and inaccurate.

The Kingdom of Nye does not guarantee the accuracy or credibility of any image or story uploaded to the site. If you find a story or image offensive please report the offense to Webmaster@thekingdomofnye.com

(E) License to User Content: Submission of any artwork, photos or stories grants The Kingdom of Nye the right to post these items to the site and to use the items for the purposes of advertising. Submitting an item implies permission to post the item and the name of the submitter unless otherwise requested. The poster retains the right to their material and can request removal of their personal material at any time by sending a request to Webmaster@thekingdomofnye.com

(F) Archives and Recorded Shows and Interviews: All Recorded materials belong to Heather Wade and The Kingdom of Nye and are provided to subscribers for the purposes of entertainment. Distribution of shows, downloading for the purpose of re-distribution without prior written consent or the sale of such material to third parties is considered Digital Theft and subject to termination of the account of all members involved and may lead to criminal prosecution.

(G) Personal Information: The Kingdom of Nye will never use the personal information of any subscriber for any other purpose than private communication when necessary. Any gathered information will never be used for the purposes of advertising or sold to a third party.

(H) Harrassment and Abuse: Harrassment includes, but is not limited to, verbally abusing or threatening Host and Staff, via email, phone calls, letters, looking glass. Creating new email addresses to circumvent bans. Calling the show with the intent of congesting the phone lines and disrupting the show. Calling the police for bogus 'welfare checks'. Such actions may result in legal action by the host and the show and banning or termination of services.

(G) Phone Calls and Other Verbal Communications: Phone calls, Skype calls or other forms of comminucation may be terminated at any time at the discretion of the host. Callers may be immediately diconnected for swearing, defaming the character of another individual or hostile intent or other conduct which the host determines is detrimental to the show. Respect for the Host, Guest, Staff and other listeners is paramount. We want to hear what you have to say so say it in a tactful and considerate way.

Knowledge of these terms and conditions is the sole responsibility of the User.
